Considering it's over 20 years old, I doubt there would be too many legal issues.
That said, it is a relatively uninteresting cpu... For low end stuff, there is 6809, Z80 and other clones, and we also have plenty of 32 bit options for higher end stuff...
A 386 based system would be more interesting, but given it's compatibility modes you would probably need to start with an 8088/8086 anyways...

I'd like to float a discussion on a PCOACH.
I think the original PC would be doable without much more work than we are expending to create some of the CPUs.
Of course, its occurred to me that the reason there are not any of those certain types of CPUs here is because everyone believes a certain lawsuit happy company would go after anyone who even thought about it.
I'd be willing to split the work on it.
