this is fixed. i noticed another thing:

./configure --target=or32 --enable-ethphy=yes --prefix=/opt/

but:

checking which execution style to use... checking whether to enable ethernet
phy emulation... no

though in config.h:

/* Whether we have ethernet PHY support */
#define HAVE_ETH_PHY 1
